Introduction

Pavlonic Inc. (“we,” “our,” or “us”) respects the intellectual property rights of others and expects users of pavlonic.com (the “Site”) to do the same. This policy outlines our procedures for handling claims of copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA).

If you believe your copyrighted work has been used on our Site in a way that constitutes infringement, you may submit a DMCA takedown notice as described below.

 

1. How to File a DMCA Takedown Notice

To submit a valid DMCA notice under 17 U.S.C. § 512(c), your written notification must include the following:

  • Your physical or electronic signature;
  • Identification of the copyrighted work claimed to have been infringed;
  • Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material;
  • Your contact information, including name, mailing address, telephone number, and email;
  • A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

We may share your notice with the user who posted the allegedly infringing material.

 

2. How to File a DMCA Counter-Notification

If you believe content you posted was wrongly removed due to a DMCA takedown request, you may submit a counter-notification. A valid counter-notice must include:

  • Your physical or electronic signature;
  • Identification of the material that was removed and the location where it appeared before removal;
  • A statement, under penalty of perjury, that you have a good faith belief that the material was removed as a result of mistake or misidentification;
  • Your name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of a court located in Nova Scotia, Canada, and that you will accept service of process from the party who submitted the original DMCA takedown notice.

 

Send your counter-notification to the same contact listed above.

Upon receiving a valid counter-notification, we may restore the content, unless the original complainant files a court action against you within 10–14 business days.

 

3. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, we reserve the right to terminate, at our discretion, users who are deemed to be repeat infringers. Repeat infringement may result in termination of account access and removal of user-generated content. See our Terms of Service for more.

We may update this DMCA Policy to reflect legal requirements or changes in how we manage copyright complaints. The “Last Updated” date at the top will be revised accordingly. Continued use of the Site constitutes acceptance of the updated policy.
